The Bay Area has more than 100 cities and towns, and each one writes its own ADU rules. That can feel overwhelming. The good news: California ADU law sets a floor that every city has to respect. Learn that floor, and you'll know what's possible in almost any Bay Area backyard.

Checklist: what to check before you place a tiny home

The State Floor Every City Shares

California's ADU Handbook explains the rules cities must follow. The ones that matter most for a backyard tiny home:

  • 800 square feet is protected. Lot coverage, floor area ratio and open space rules can't block an ADU of at least 800 square feet with 4-foot side and rear setbacks.

  • Size caps can't be too small. A city's maximum must allow at least 850 square feet, or 1,000 for more than one bedroom.

  • Tiny is OK. Cities can't set a minimum size that blocks an efficiency unit, which can be as small as 150 square feet.

  • No owner-occupancy rule for ADUs, with narrow exceptions.

  • 60-day decision. A complete application must be approved or denied within 60 days when there's already a home on the lot.

  • Parking breaks. No parking can be required for ADUs within a half mile walk of public transit, and in a few other cases.

Rentals: cities can require ADU rentals to be 30 days or longer, so plan on long-term tenants, not vacation stays.

Tiny Homes on Wheels: City by City

State ADU law doesn't mention tiny homes. The Handbook says a tiny home is "possibly" an ADU, if it meets the state ADU definition. So each city decides how to treat a tiny home on wheels.

San Jose is the clearest example. The City of San José says tiny homes on wheels are a type of ADU, allowed only on single-family properties, with different requirements and a simpler, lower-cost permit process. Its Bulletin 291 lists the checklist.

Elsewhere in the Bay Area, a foundation ADU is the safer bet until you know your city's rule.

Bay Area Factors to Plan For

  • Solar: newly built detached ADUs generally need solar under the California Energy Code (manufactured homes excluded). Panels can go on the ADU or the main house.

  • Hills and access: steep lots and narrow streets in places like the East Bay hills can make delivery harder.

  • Small lots: a 20' to 24' home often fits where a larger ADU won't.

Your Bay Area Checklist

  • Find your city's ADU page and zoning.

  • Start from the state floor: 800 square feet, 4-foot setbacks.

  • Decide on wheels (only where your city allows) or a foundation.

  • Measure the delivery path from the street.

  • Book a $500 site assessment to see what fits your lot.

How Zen Tiny Homes Helps

  • $500 site assessment: we check your spot, delivery access and utility hookups.

  • Plans: the Alpine (a flex plan in 20', 22' or 24', starting around $50K), the Mammoth (up to 30', starting around $75K), the Container (starting around $40K), or Custom. Every home is custom, so final pricing depends on your design.

  • Build and delivery: built off-site, then delivered and set up.

  • Reserve your spot: a $500 deposit holds your place on the build list.

Frequently Asked Questions

Can my Bay Area city block a small backyard ADU?

State law says lot coverage, floor area ratio and open space rules can't block an ADU of at least 800 square feet with 4-foot side and rear setbacks.

Do I have to live on the property to build an ADU?

No. Under state law, cities can't require owner occupancy for an ADU, except for ADUs sold separately to a qualified buyer. Junior ADUs with shared bathrooms are different.

Can a tiny home on wheels be an ADU in the Bay Area?

It depends on the city. State ADU law doesn't mention tiny homes, but San Jose says tiny homes on wheels are a type of ADU, allowed only on single-family properties with a simpler, lower-cost permit.

How fast will my city decide on an ADU?

A complete ADU application must be approved or denied within 60 days when there's already a home on the lot.
