Can I Put a Tiny Home on My Own Land in California?

Buying land and placing a tiny home on it is a popular dream. It is also where people most often get stuck. Here is what the rules actually say.

Modern tiny home on a rural pine-forest lot in California

The key point: it has to be a legal dwelling

Living on vacant land means the tiny home is the primary dwelling. It must be one of the state-recognized types (HCD IB 2016-01):

  • A house on a foundation built to the California Residential Code: the most widely accepted path.

  • A manufactured home (HUD-code, 320 sq ft or more when set up), which may be placed outside parks with the proper installation approval.

  • A tiny home on wheels: only if your county or city specifically allows a THOW as a primary dwelling. Otherwise park trailers and RVs generally may be occupied only in parks.

ADU law does not help on empty land, because an ADU is accessory to a primary home on the same lot.

Places that allow a THOW as a primary home (verified examples)

  • Unincorporated San Diego County: since Sept 4, 2025, a THOW can be a primary or accessory dwelling. It must be under 430 sq ft, one floor plus a loft up to 150 sq ft, no taller than 16 ft, certified to ANSI A119.5, and have noncombustible exterior walls and a fire-resistant roof; some need sprinklers (County PDS).

  • Santa Cruz County: a THOW can be the primary unit, but then it needs fire sprinklers; one per parcel; max 400 sq ft (County CDI).

  • City of Fresno: tiny homes on wheels are not allowed as the primary dwelling, only as a backyard cottage (City of Fresno).

Every other county: check locally. We publish county guides as we verify them.

What raw land usually needs

These are commonly required, but exact rules vary by county:

  • Legal lot status and zoning that allows a dwelling (San Diego County lists legal lot checks) (County PDS).

  • Water: a utility connection or an approved well.

  • Sewage: sewer or an approved septic (OWTS) system. Santa Cruz does not accept a composting toilet as a substitute (Santa Cruz).

  • Power: utility or a designed off-grid system. Santa Cruz requires solar plus batteries for off-grid and limits generators.

  • Fire access, grading, stormwater, and flood checks (San Diego County lists all of these).

Before you buy land

  1. Find out before you buy: "Can a tiny home on wheels be a primary dwelling on this parcel? If not, what's the smallest permitted home?"

  2. Check septic feasibility and water first. They often cost more than the home.

  3. Check fire hazard zone and road access.

  4. Book Zen's $500 site assessment before you commit.

Frequently asked questions

Can I put a tiny home anywhere on my land?

No. It must be a legal dwelling type and meet zoning, setback and utility rules. A home on wheels works only where your county or city allows it as a primary home.

Do I need a permit to put a tiny home on my land?

Yes. Expect planning and building review, and often septic, well, fire and grading reviews too.

Can I build a tiny home without a permit in California?

You can't legally live in it. A tiny home that isn't an approved type is a noncomplying structure, and living in it is illegal (HCD IB 2016-01).

Which counties allow a tiny house on wheels as a primary home?

Verified examples include unincorporated San Diego County (County PDS), Santa Cruz County (with fire sprinklers, Santa Cruz County), Placer County (certain zones) and Nevada County. The City of Fresno does not.

What should I check before buying land for a tiny home?

Check legal lot status, zoning, water, sewer or septic, power, fire hazard zone and road access. Book Zen's $500 site assessment before you commit.
