Short answer: Yes, but only if the home is built to one of the standards the state recognizes and it sits on a site where that type is allowed. California has no single "tiny home" law. (HCD Information Bulletin 2016-01)

The legal "types" a tiny home can be

According to the state housing department (HCD), a tiny home must be approved as one of these (IB 2016-01):

  • Park trailer (park model RV): on a chassis with wheels, 400 sq ft or less (lofts can be excluded if they meet state rules), built to ANSI A119.5 / NFPA 1192. Meant for "recreational or seasonal use only." (HSC §18009.3)

  • Recreational vehicle (RV): also not intended as a permanent dwelling.

  • California Residential/Building Code home: a small house built on site, usually on a foundation. It must meet normal house standards, e.g. a 7 ft 6 in minimum ceiling height (with exceptions) and at least one room of 120 sq ft.

  • Manufactured home: HUD-code; 320 sq ft or more when set up.

  • Factory-built housing: HCD notes it had not approved any factory-built units as tiny homes when it wrote the bulletin.

A tiny home that fits none of these is a "noncomplying" structure, and living in it is illegal. (IB 2016-01)

Wheels vs. foundation: the big fork

  • On wheels: Unless a local ordinance allows otherwise, park trailers and RVs generally may be lived in only in mobilehome parks or special occupancy (RV) parks. (IB 2016-01) Some cities and counties now have such ordinances (see our county guides).

  • On a foundation: It is a house in the eyes of the law. In a backyard, it can be permitted as an ADU under state ADU law. (HCD ADU Handbook)

Is a tiny home on wheels an ADU?

Usually not under state law. HCD has said movable tiny homes "may not meet the statutory definition of an ADU" and "may be more akin to recreational vehicles." (HCD letter, June 24, 2025) Some cities allow them under their own separate rules instead.

How to check your site, step by step

  1. Find out who regulates your parcel: a city (if incorporated) or the county.

  2. Search their code for "movable tiny house" or "tiny home on wheels."

  3. If there's no ordinance, plan for a foundation ADU or a park.

  4. Most local THOW rules require ANSI A119.5 or NFPA 1192 certification. All Zen Tiny Homes are built to ANSI standards.

  5. Get the answer in writing before you buy.

Frequently asked questions

Can you legally live in a tiny home in California full-time?

Yes, if it is a legal type (a foundation home, a manufactured home, or a tiny home on wheels where a local ordinance allows it) on a site that permits it. Otherwise park trailers and RVs are meant for parks (HCD IB 2016-01).

Are tiny homes on wheels legal in California?

Yes in RV and mobilehome parks. On private land, only where your city or county has an ordinance that allows them.

Where are tiny homes legal in California?

A foundation tiny home can go wherever zoning allows a house or an ADU. A tiny home on wheels can go in parks, or in places with a local ordinance, such as the City of San Diego, unincorporated San Diego County, the City of Los Angeles, Santa Cruz County and the City of Fresno (see our county guides).

Are tiny homes illegal anywhere in California?

A tiny home that isn't built to a recognized standard is a "noncomplying" structure, and living in it is illegal anywhere in the state (HCD IB 2016-01). A legal type can still be barred on a given lot by local zoning.

Do I need a permit for a tiny home in California?

Yes. Any tiny home you live in needs local approval, whether it is a house, an ADU or a permitted tiny home on wheels. See our permit steps.
