How to Permit a Tiny Home in California: Step by Step

Permits are handled by your city (if you're inside city limits) or your county (if unincorporated). Below are the steps that apply almost everywhere; details vary locally.

Step 1: Identify the type

Decide between a foundation home/ADU and a tiny home on wheels. They follow different rules (HCD IB 2016-01). See Wheels vs. Foundation.

Step 2: Check zoning and overlays

Questions to answer for your lot:

  • Is my zone residential? Does it allow ADUs or movable tiny houses?

  • Am I in a fire hazard, flood, coastal, or habitat zone? For example, the City of San Diego bars movable tiny houses in brush management zones and its habitat preserve (MHPA) (SDMC §141.0318), and Santa Cruz County bars THOWs in flood hazard areas (Santa Cruz).

Step 3: Site assessment and site plan

Measure where the home goes, the path in, setbacks, and utility runs. Typical local requirements include:

  • City of San Diego THOW: at least 5 ft from side/rear lot lines, 10 ft from other structures, a 5-ft-wide access path, not in the front yard (SDMC §141.0318)

  • ADUs statewide: local rules can't require more than 4-ft side and rear setbacks for an ADU of at least 800 sq ft (HCD ADU Handbook)

Step 4: Certification (THOWs) or plans (foundation)

  • THOW: most local ordinances require certification to ANSI A119.5 or NFPA 1192 by a recognized agency, with a label on the home. San Diego County lists approved certification agencies (County PDS). All Zen Tiny Homes are built to ANSI standards.

  • Foundation: full construction plans to the California Residential Code, including Title 24 energy.

Step 5: Submit

San Diego County, for example, asks for two printed plan sets (11x17 minimum) with a plot plan, project scope, certification letter and stormwater forms (County PDS). For ADUs and JADUs, the agency must tell you within 15 business days whether your application is complete (HCD ADU Handbook).

Step 6: Inspections

Even a certified THOW gets local inspections for the installation: underground plumbing and electrical, water service, sewer, fire, and final (County PDS). Certification "is not a substitute for required county inspections."

Step 7: Final sign-off and registration

  • Foundation: certificate of occupancy / final.

  • THOW: final inspection, plus keep the DMV registration current. In Santa Cruz County, letting registration lapse makes the THOW permit expire (Santa Cruz).

Fees

Permit, plan-check and utility fees vary by city and county. Ask for a fee estimate. One statewide rule: no impact fees on ADUs of 750 sq ft or less of interior livable space (HCD ADU Handbook).

Frequently asked questions

Do you need a permit for a tiny house on wheels in California?

Yes, to live in one outside a park. Even a certified home gets local inspections of its installation (County PDS).

What zoning allows tiny homes?

Residential zones that allow a house or an ADU allow a foundation tiny home. Homes on wheels are allowed only in the zones your local code lists (Placer County is one example).

How long does a tiny home permit take?

For ADUs, the agency must tell you within 15 business days whether your application is complete. A complete application not acted on within 60 days is deemed approved (HCD ADU Handbook). Other timelines vary locally.

How much does a tiny home permit cost?

It varies by city and county, so ask for a written fee estimate. ADUs of 750 sq ft or less pay no impact fees (HCD ADU Handbook).
